1. Terms of Service

1.1 Acceptance of Terms

By downloading, installing, or using Digi-Dash ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

1.2 License Grant

Educacion Global, Inc. grants you a limited, non-exclusive, non-transferable, revocable license to use Digi-Dash for personal, non-commercial purposes on iOS devices that you own or control.

1.3 Restrictions

You agree not to:

Modify, reverse engineer, decompile, or disassemble the App
Remove any copyright or proprietary notices from the App
Use the App for any illegal or unauthorized purpose
Attempt to gain unauthorized access to any portion of the App
Interfere with or disrupt the App's functionality

1.4 AI Service Integration

Digi-Dash integrates with third-party AI services (OpenAI, Google Gemini) to generate game content. By using these features, you acknowledge that:

You must provide your own API keys for these services
Your use of AI services is subject to the respective provider's terms
Educacion Global, Inc. is not responsible for the availability or performance of third-party AI services
API usage costs are your responsibility

1.5 Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. Educacion Global, Inc. does not warrant that the App will be uninterrupted, secure, or error-free.

1.6 Limitation of Liability

To the maximum extent permitted by law, Educacion Global, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the App.

1.7 Intellectual Property Rights

All rights, title, and interest in and to the App, including all copyrights, trademarks, trade secrets, and other intellectual property rights, are and will remain the exclusive property of Educacion Global, Inc.

User-Generated Content: Content generated through AI services using your API keys is subject to the respective AI provider's terms. Educacion Global, Inc. makes no claims to content you generate.

Trademarks: "Digi-Dash" and associated logos are trademarks of Educacion Global, Inc. You may not use these marks without prior written consent.

1.8 User Responsibilities

You are solely responsible for:

Maintaining the security and confidentiality of your API keys
All costs associated with third-party AI service usage
Ensuring your use of the App complies with all applicable laws
Not using AI-generated content for illegal, harmful, or unethical purposes
Complying with the terms of service of any third-party AI providers
Supervising minors' use of the App if applicable

1.9 Indemnification

You agree to indemnify, defend, and hold harmless Educacion Global, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your access to or use of the App
Your violation of these Terms
Your violation of any third-party rights, including AI service providers
Your misuse of API keys or generated content
Any costs incurred through your use of third-party AI services

1.10 Termination

These Terms are effective until terminated by either party. You may terminate by uninstalling the App and ceasing all use. Educacion Global, Inc. reserves the right to terminate or restrict your access to the App at any time, with or without cause or notice.

Upon termination:

Your license to use the App immediately ceases
You must delete all copies of the App from your devices
All locally stored data will be deleted upon uninstallation
Sections that by their nature should survive (Indemnification, Limitation of Liability, Governing Law) will continue to apply

1.11 Service Availability

Educacion Global, Inc. reserves the right to:

Modify, suspend, or discontinue the App at any time without notice
Change features, functionality, or requirements
Cease providing updates or support
Remove the App from the App Store

We make no guarantee regarding the availability, reliability, or future support of the App.

1.12 Apple App Store Terms

You acknowledge and agree that:

These Terms are between you and Educacion Global, Inc., not Apple Inc.
Apple has no obligation to provide maintenance or support for the App
Apple is not responsible for addressing any claims relating to the App
Apple is a third-party beneficiary of these Terms and may enforce them
You must comply with all applicable third-party terms when using the App
Your use of the App must comply with the Apple App Store Terms of Service

1.13 Export Compliance

The App may be subject to export control laws and regulations. You agree to comply with all applicable international and national laws, including U.S. Export Administration Regulations. You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.

1.14 Force Majeure

Educacion Global, Inc. shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labor disputes, internet or telecommunications failures, third-party AI service outages, or government actions.

1.15 Governing Law & Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Dispute Resolution: Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. Arbitration shall take place in Delaware, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and Educacion Global, Inc. individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.

Exceptions: Either party may seek injunctive relief in any court of competent jurisdiction to prevent actual or threatened infringement or misappropriation of intellectual property rights.

1.16 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

1.17 Entire Agreement

These Terms constitute the entire agreement between you and Educacion Global, Inc. regarding the App and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

1.18 Changes to Terms

Educacion Global, Inc. reserves the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the modified terms. Material changes will be indicated by updating the "Last Updated" date at the top of this document.

2. Privacy Policy

2.1 Data Collection

We collect ZERO personal data. Digi-Dash is designed with privacy as a core principle:

No user accounts or registration required
No analytics or tracking
No telemetry or usage data collection
No network requests except those you initiate to AI services
No advertising or third-party SDKs

2.2 Local Data Storage

All game data is stored locally on your device:

Game scores and statistics (stored in UserDefaults)
App settings and preferences
API keys (stored securely in iOS Keychain)

This data never leaves your device and is deleted when you uninstall the App.

2.3 API Keys

If you choose to use AI-powered features, you must provide your own API keys for OpenAI or Google Gemini. These keys are:

Stored securely in the iOS Keychain
Never transmitted to Educacion Global, Inc. servers
Only used to communicate directly with the respective AI service
Your responsibility to manage and secure

2.4 Third-Party Services

When you use AI features with your own API keys, you are communicating directly with:

OpenAI: Subject to OpenAI Privacy Policy
Google Gemini: Subject to Google Privacy Policy

Educacion Global, Inc. has no control over and assumes no responsibility for the privacy practices of these third-party services.

2.5 Haptic Feedback

The App uses iOS native haptic feedback for game interactions. This is handled entirely by iOS and does not involve any data collection.

2.6 Data Security

Since all data is stored locally on your device, security is managed by iOS. We recommend:

Using device passcode/biometric authentication
Keeping iOS updated to the latest version
Protecting your API keys as you would passwords

2.7 Children's Privacy

Digi-Dash does not knowingly collect any data from users of any age. The App is suitable for all ages and operates entirely offline (except for optional AI features).

Age Requirements & Parental Consent:

Users under 13 years of age must have parental or guardian consent to use the App
Parents/guardians are responsible for supervising minors' use of the App
If AI features are used, parents/guardians must supervise API key management and usage costs
We recommend parents review generated content to ensure age-appropriateness

Since we collect no data, we comply with COPPA (Children's Online Privacy Protection Act) by default. However, third-party AI services may have their own age restrictions and policies.

2.8 International Users

While the App stores all data locally, if you use AI features, your API requests will be processed by third-party services that may be located in different countries. You are responsible for ensuring your use complies with local data protection laws including GDPR, CCPA, or other applicable regulations.

2.9 Your Rights

Since we don't collect your data, there's nothing for us to access, delete, or transfer. You have complete control over all App data through:

iOS Settings app (to manage app permissions)
Digi-Dash Settings (to clear game data)
Uninstalling the App (removes all data)
Managing your own API keys directly with service providers

GDPR Rights: If you are in the EU, you have rights to access, rectify, and erase personal data. Since we don't collect your data, these rights apply only to data processed by third-party AI services you choose to use.

CCPA Rights: If you are a California resident, you have rights regarding personal information. As we don't collect, sell, or share your data, these rights apply only to third-party services you interact with.

2.10 Changes to Privacy Policy

Any changes to this privacy policy will be reflected in this document with an updated "Last Updated" date. Since the App operates locally, you'll see updates when you visit this page. Continued use after changes constitutes acceptance.

5. Additional Legal Information

5.1 No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. USE AT YOUR OWN RISK.

5.2 Limitation of Damages

IN NO EVENT SHALL EDUCACION GLOBAL, INC. BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THIS MAY NOT APPLY TO YOU.

5.3 Maximum Liability

In jurisdictions where limitation of liability is permitted, Educacion Global, Inc.'s total liability to you for all claims arising from or related to the App shall not exceed the amount you paid for the App (if any) or $100 USD, whichever is greater.

5.4 Acknowledgment

By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Privacy Policy. If you do not agree, you must immediately cease using the App and delete it from your device.
